Terms of Service

1. Acceptance of Terms
Welcome to Haulr. These Terms of Service ("Terms") constitute a legally binding agreement between you and Haulr Technologies LLC ("Haulr", "we", "our", or "us") governing your access to and use of the Haulr mobile application, website, and all related services (collectively, the "Service").
By creating an account, downloading the app, or otherwise accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you must not access or use the Service.
These Terms apply to all users of the Service, including customers who request hauling services and independent drivers who fulfill those requests.
2. Description of Service
Haulr is an on-demand hauling and delivery platform that connects customers who need items picked up and moved with independent drivers who provide hauling services using their own vehicles. Haulr provides the technology platform that facilitates these connections and does not itself provide hauling, moving, or transportation services.
Key features of the Service include:
- Upfront, transparent pricing calculated based on distance, item size category, and selected add-on services (e.g., extra helpers, stairs, disassembly)
- Real-time driver matching and intelligent dispatch based on driver proximity, vehicle capacity, and availability
- Live GPS tracking during active hauls so customers can monitor their items in transit
- Secure payment processing through Stripe, including customer charges and driver payouts
- Two-way rating and review system for quality assurance
- In-app communication between customers and assigned drivers
- Photo documentation of items at pickup and delivery for dispute resolution
3. Eligibility
All Users must:
- Be at least 18 years of age
- Have the legal capacity to enter into a binding agreement
- Provide accurate, truthful, and complete registration information
- Maintain the security and confidentiality of their account credentials
- Reside in or be located within a geographic area where the Service is available
Additional Requirements for Customers:
- Must have a valid payment method (credit card, debit card, or other accepted payment method) on file
- Must provide accurate pickup and dropoff addresses and item descriptions when requesting a haul
- Must be present or have an authorized representative present at pickup and dropoff locations (or arrange for unattended pickup/delivery if supported)
Additional Requirements for Drivers:
- Must possess a valid, unexpired driver's license issued in the United States
- Must maintain valid, active auto insurance that meets or exceeds state minimum coverage requirements
- Must successfully complete a background check conducted through our verification partner
- Must own or have authorized access to a vehicle suitable for hauling (truck, van, SUV, or trailer)
- Must be legally authorized to work in the United States
- Must maintain a driver rating of 4.0 or higher to remain active on the platform
4. User Accounts
You are responsible for maintaining the confidentiality of your account login credentials and for all activities that occur under your account. You agree to:
- Provide accurate, current, and complete information during registration and keep it updated
- Create only one account per person (duplicate accounts may be merged or terminated)
- Not transfer, sell, or share your account with any other person
- Notify us immediately at support@haulrapp.com of any unauthorized access to or use of your account
- Not impersonate any other person or entity or misrepresent your affiliation with any person or entity
We reserve the right to suspend, disable, or terminate any account at our sole discretion if we determine that the account holder has violated these Terms, engaged in fraudulent activity, or poses a risk to the safety of other users or the integrity of the platform.
5. Pricing & Payment
For Customers:
- Prices are calculated upfront at the time of booking based on the distance between pickup and dropoff locations, the item size category (small, medium, large, extra-large), and any selected add-on services
- The price displayed at the time of booking confirmation is the final price you will be charged — there are no hidden fees, surge pricing, or surprise charges
- Payment is authorized and processed securely through Stripe at the time of booking
- Applicable sales tax is calculated and included in the total price where required by law
- Refunds for cancelled or incomplete hauls are processed in accordance with our Cancellation Policy (Section 6)
For Drivers:
- Drivers receive 80% of the total haul price as their payout for each completed job
- Haulr retains a 20% platform fee to cover payment processing, insurance, technology infrastructure, and operational costs
- Payouts are processed through Stripe Connect and deposited directly into the driver's linked bank account
- Payout timing depends on the driver's Stripe Connect account status and may take 2-7 business days for initial payouts
- Drivers are solely responsible for reporting and paying all applicable income taxes, self-employment taxes, and other tax obligations
- Haulr will provide 1099-NEC tax forms to drivers who earn $600 or more in a calendar year, as required by the IRS
6. Cancellation Policy
We understand that plans change. Our cancellation policy is designed to be fair to both customers and drivers:
- Before driver assignment: Customers may cancel at any time for a full refund with no cancellation fee
- After driver assignment, before pickup: Customers may cancel, but a cancellation fee of up to $15 may apply to compensate the driver for time and fuel already spent en route. The exact fee depends on how far the driver has traveled toward the pickup location.
- After pickup (items in transit): The full haul amount is charged. If there is a legitimate dispute (e.g., driver no-show, significant service issue), customers may submit a dispute through our support team at support@haulrapp.com for review
Driver Cancellations: Drivers who repeatedly cancel accepted jobs without valid reason may face temporary suspension or permanent removal from the platform. Valid reasons for driver cancellation include safety concerns, vehicle breakdown, or other unavoidable circumstances.
Refunds are processed back to the original payment method and typically appear within 5-10 business days.
7. Prohibited Items
The following items are strictly prohibited from being hauled through the Haulr platform. Drivers have the right to refuse any job that involves prohibited items:
- Hazardous Materials: Flammable liquids, explosives, compressed gases, radioactive materials, corrosive substances, toxic chemicals, or any materials regulated under DOT hazardous materials guidelines
- Illegal Goods: Controlled substances, stolen property, counterfeit goods, or any items that are illegal to possess, transport, or sell under federal, state, or local law
- Firearms & Weapons: Guns, ammunition, explosives, knives with blades over 6 inches, or other weapons (unless being transported by a licensed dealer with proper documentation)
- Live Animals: Pets, livestock, or any living creatures (service animals accompanying a customer are permitted)
- Perishable Food: Items requiring temperature-controlled transport (Haulr vehicles are not refrigerated)
- Human Remains: Including cremated remains or ashes
- Extremely Heavy or Oversized Items: Items exceeding 500 lbs per piece or requiring specialized equipment such as cranes or forklifts, unless arranged in advance
If a customer requests hauling of a prohibited item, the driver should decline the job and report it through the app. Customers who repeatedly attempt to haul prohibited items may have their accounts suspended or terminated.
8. User Conduct
All users of the Haulr platform agree to conduct themselves in a respectful, lawful, and professional manner. You agree not to:
- Use the Service for any illegal, unauthorized, or fraudulent purpose
- Harass, threaten, intimidate, stalk, or discriminate against other users, drivers, or Haulr staff on the basis of race, gender, religion, sexual orientation, disability, or any other protected characteristic
- Provide false, misleading, or inaccurate information in your profile, hauling requests, or communications
- Attempt to circumvent the platform's payment system by arranging off-platform payments with drivers or customers
- Use the Service while under the influence of drugs or alcohol (especially drivers)
- Damage, vandalize, or steal property belonging to other users, drivers, or third parties
- Interfere with or disrupt the proper functioning of the Service, its servers, or connected networks
- Use automated scripts, bots, scrapers, or other automated means to access the Service without our written permission
- Collect or harvest personal information of other users without their consent
- Post or transmit any content that is defamatory, obscene, or otherwise objectionable
Violations of this conduct policy may result in warnings, temporary suspension, or permanent termination of your account, at our sole discretion.
9. Independent Contractor Relationship
Drivers who use the Haulr platform to provide hauling services are independent contractors, not employees, agents, joint venturers, or partners of Haulr Technologies LLC. This independent contractor relationship means that drivers:
- Have complete control over their own schedule, working hours, and geographic area of operation
- Are free to accept or decline any hauling request at their sole discretion
- Provide their own vehicle, fuel, tools, equipment, and supplies needed to perform hauling services
- Are solely responsible for their own auto insurance, health insurance, taxes (including self-employment tax), and all other business expenses
- Are not entitled to employment benefits from Haulr, including but not limited to health insurance, retirement plans, paid time off, workers' compensation, or unemployment insurance
- May use competing platforms or provide hauling services independently without restriction
Nothing in these Terms or in the use of the Haulr platform creates an employment relationship, agency, or partnership between Haulr and any driver. Haulr does not control the manner, method, or means by which drivers perform hauling services.
10. Insurance & Liability
Cargo Protection: Haulr provides basic cargo protection for items during active transit (from the time items are loaded at pickup to unloading at the dropoff location). This protection covers accidental damage or loss that occurs during the haul due to the driver's handling.
Coverage Limits and Exclusions:
- Maximum coverage is limited to the lesser of the declared value of the items or $1,000 per haul
- Customers hauling high-value items (over $500) should declare the value at booking time and consider obtaining supplemental insurance from a third-party provider
- Haulr is not liable for damage caused by improper packaging, wrapping, or preparation of items by the customer
- Haulr is not liable for damage to items that are inherently fragile, perishable, or unsuitable for transport in a standard vehicle
- Haulr is not liable for items delivered to the wrong address if the customer provided incorrect dropoff information
- Pre-existing damage, normal wear and tear, and damage caused by acts of nature (weather, road conditions) are excluded
Claims Process: Damage or loss claims must be filed within 48 hours of haul completion by contacting support@haulrapp.com with photos of the damage and a description of the items affected. Claims will be reviewed and resolved within 14 business days.
Driver Insurance: All drivers are required to maintain valid personal auto insurance. Haulr does not provide commercial auto insurance coverage for drivers. Drivers are responsible for understanding their own insurance policy's coverage and exclusions related to commercial hauling activity.
11. Ratings & Reviews
Haulr operates a two-way rating system to maintain quality and trust on the platform:
- After each completed haul, both the customer and driver can rate each other on a 1 to 5 scale and leave an optional written review
- Ratings are anonymous during the review period and become visible to both parties once both have submitted their rating (or after 24 hours, whichever comes first)
- Reviews must be honest, factual, and related to the hauling experience. Reviews that contain hate speech, personal attacks, discriminatory language, or false claims will be removed
- Drivers must maintain a minimum average rating of 4.0 to remain active on the platform. Drivers whose rating drops below this threshold will receive a warning and a grace period to improve
- Customers with consistently low ratings may also face account review
- Haulr reserves the right to remove or modify reviews that violate our community guidelines
Ratings are a critical part of the Haulr ecosystem and help us ensure a safe, reliable experience for all users. We encourage both customers and drivers to leave honest, constructive feedback.
12. Intellectual Property
The Service, including but not limited to its design, user interface, logos, trademarks, service marks, text, graphics, images, icons, software, source code, algorithms, and underlying technology, is the exclusive property of Haulr Technologies LLC and is protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.
You may not, without our prior written consent:
- Copy, reproduce, modify, adapt, or create derivative works based on any part of the Service
- Use the Haulr name, logo, or any of our trademarks or service marks for any purpose without written authorization
- Reverse engineer, decompile, disassemble, or attempt to extract the source code of the application or any part thereof
- Remove, alter, or obscure any copyright, trademark, or other proprietary notices from the Service
- Sublicense, sell, resell, transfer, assign, or distribute any part of the Service
User Content: By submitting content to the Service (such as photos, reviews, and item descriptions), you grant Haulr a non-exclusive, worldwide, royalty-free, transferable license to use, display, and distribute that content in connection with operating and improving the Service.
13. Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
WITHOUT LIMITING THE FOREGOING, HAULR DOES NOT WARRANT THAT:
- The Service will be uninterrupted, timely, error-free, or secure at all times
- The results obtained from using the Service will be accurate or reliable
- The quality, safety, legality, or timeliness of hauling services provided by independent drivers will meet your expectations
- Any defects or errors in the Service will be corrected
- A driver will be available in your area at any given time
You acknowledge that Haulr is a technology platform that connects customers with independent drivers and does not directly provide hauling services. Your use of the Service and reliance on any information provided through the Service is at your sole risk.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL HAULR TECHNOLOGIES LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of profits, revenue, data, use, goodwill, or other intangible losses
- Personal injury or property damage arising from your use of or inability to use the Service
- Any conduct or content of any third party on the Service, including drivers and other users
- Unauthorized access to or alteration of your data or transmissions
- Any other matter relating to the Service
IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE EXCEED THE GREATER OF (A) THE AMOUNTS YOU HAVE PAID TO HAULR IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE LIMITATIONS MAY NOT APPLY, AND YOU MAY HAVE ADDITIONAL RIGHTS.
15. Indemnification
You agree to indemnify, defend, and hold harmless Haulr Technologies LLC, its parent companies, subsidiaries, affiliates, officers, directors, employees, agents, licensors, and service providers from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees and court costs) arising out of or related to:
- Your access to or use of the Service
- Your violation of any provision of these Terms
- Your violation of any third-party right, including any intellectual property, privacy, or proprietary right
- Any content, information, or materials you submit, post, or transmit through the Service
- Your negligent or willful misconduct
- Any dispute between you and another user or driver arising from the use of the Service
This indemnification obligation shall survive the termination of your account and these Terms.
16. Dispute Resolution
Informal Resolution: Before initiating any formal legal proceeding, you agree to first contact us at support@haulrapp.com to attempt to resolve the dispute informally. We will work in good faith to resolve the issue within 30 days of receiving your written notice of the dispute.
Binding Arbitration: If a dispute cannot be resolved informally within 30 days, you and Haulr agree that any and all disputes, claims, or controversies arising out of or relating to these Terms or the Service shall be resolved exclusively through final and binding arbitration, rather than in court. Arbitration shall be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules and conducted in Oakland County, Michigan.
Arbitration Procedures:
- Either party may initiate arbitration by filing a demand with the AAA
- The arbitration shall be conducted by a single, neutral arbitrator selected in accordance with AAA rules
- The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction
- Each party shall bear its own costs and attorney's fees, unless the arbitrator determines otherwise
Class Action Waiver: YOU AND HAULR AGREE THAT ALL DISPUTES SHALL BE RESOLVED ON AN INDIVIDUAL BASIS ONLY. YOU WAIVE YOUR RIGHT TO PARTICIPATE IN OR BRING A CLASS ACTION, COLLECTIVE ACTION, CONSOLIDATED ACTION, OR REPRESENTATIVE PROCEEDING OF ANY KIND AGAINST HAULR.
Exceptions: Notwithstanding the above, either party may seek injunctive or equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.
17. Governing Law
These Terms, and any disputes arising out of or related to these Terms or the Service, shall be governed by and construed in accordance with the laws of the State of Michigan, United States, without regard to its conflict of law principles.
For any matters not subject to arbitration as described in Section 16, or where arbitration is found unenforceable, you consent to the exclusive jurisdiction and venue of the state and federal courts located in Oakland County, Michigan.
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.
18. Termination
We may terminate or suspend your account and access to the Service immediately, with or without prior notice or liability, for any reason, including but not limited to:
- Violation of any provision of these Terms
- Fraudulent, abusive, or illegal activity
- Failure to maintain required driver documentation (for driver accounts)
- Sustained low ratings below the platform minimum
- Extended periods of account inactivity (12+ months)
- At your request (voluntary account deletion)
Upon Termination:
- Your right to access and use the Service ceases immediately
- Any outstanding payments owed to drivers for completed hauls will be processed and paid out
- We may retain certain data as required by law, for legitimate business purposes, or as described in our Privacy Policy
- Provisions of these Terms that by their nature should survive termination shall remain in effect, including but not limited to Sections 13, 14, 15, 16, and 17
You may delete your account at any time through the app settings or by contacting us at support@haulrapp.com.
19. Changes to Terms
We reserve the right to modify, amend, or replace these Terms at any time at our sole discretion. When we make changes, we will:
- Post the updated Terms on this page with a revised "Last Updated" date
- Notify registered users of material changes via push notification, email, or in-app notice at least 30 days before the changes take effect
- Clearly identify what sections have been modified in our change notifications
Your continued use of the Service after the updated Terms become effective constitutes your acceptance of and agreement to the revised Terms. If you do not agree to the updated Terms, you must stop using the Service and delete your account.
We encourage you to review these Terms periodically to stay informed of any changes. The most current version of the Terms will always be available at haulrapp.com/terms.
